Riffs Yoga Studios Disclosure and Release Form

I, the undersigned Client, agree that by signing this document, I am waiving certain legal rights, including the right to sue Riffs Yoga Studios, located at 5510 La Jolla Blvd, La Jolla, CA, 92037, (858) 456-2477, and its shareholders, directors, officers, employees, representatives, agents, and affiliates for any physical injury or damages, including death, that may happen to me before, during, or after my participation in any of the services (hereinafter, "Services") provided by Riffs Yoga Studios.
My signature below confirms that I understand, agree with, and accept the following:
I acknowledge that the Services may involve one, all, or any combination of deep breathing exercises, yoga, contrast exposure (alternating full-body immersions in pools/tubs of extremely cold and hot water), the use of a high-temperature sauna, and red light panels emitting red light and near-infrared frequencies, and massage.
I acknowledge that participation in any of the Services could result in physical effects and injuries that could include dehydration, fatigue, indigestion, soreness, tenderness, redness, swelling, dizziness, fainting, muscle strains and tears, sprains, bone fractures, and other musculoskeletal injuries, scarring, bruising, bleeding, blood clots, transient ischemic attacks, strokes, nerve injury, headaches, migraines, loss of consciousness, amnesia, seizures, hypotension, arrhythmia, hyperthermia, hypothermia, hyperpigmentation, drowning, and infection.
I acknowledge that participation in deep breathing exercises will include holding my breath for extended periods and inhaling and exhaling in a manner that will not be normal for me.
I acknowledge that participation in contrast exposure involves alternating full-body (except neck and head) immersions in extremely cold water, which could be as cold as 34 degrees Fahrenheit, and hot water, which could exceed 104 degrees Fahrenheit.
I acknowledge that participation in yoga exercises involves physical movements into and from unnatural body positions, stretching muscles, and breathing in unnatural ways.
I acknowledge that the use of a sauna involves exposure to extremely high temperatures, which could exceed 170 degrees Fahrenheit.
I acknowledge that the use of red light therapy panels involves exposure to LED peak wavelengths of 630nm, 660nm, 810nm and 830nm, which could have an adverse effect on tissues and eyes that are sensitive to these frequencies.
I acknowledge that the receival of massage services involve the physical touch of a licensed massage therapist in a private room at the clothing level of my comfort.
I acknowledge that participation in the contrast exposure Services and use of the sauna will involve walking on hard surfaces that may be wet and slippery.
I acknowledge that my use of Riffs Yoga Studios' Services and facilities will, at times, be unsupervised, and that I am always responsible for determining what type and level of use are safe and appropriate for me.
I affirm that I have no health or medical condition that would endanger me when participating in any of the Services.
I acknowledge that it is strongly recommended that I consult with a physician and receive a physician's consent before participating in any of the Services; this consent is especially important for those who are pregnant, could be pregnant, or have any pre-existing health or medical conditions.
I agree that participation in the Services is not a substitute for actual medical care and acknowledge that if I do experience any pain, discomfort, or medical issue before, during, or after participating in the Services, I must immediately stop my participation, notify the Riffs Yoga Studios staff, and contact my physician.
I agree that Riffs Yoga Studios offers the Services with no guarantee of any particular results. I agree and confirm that all of the information that I have provided, and will continue to provide, to Riffs Yoga Studios and its employees and representatives is accurate, complete, up-to-date, and without the omission of any known medical issues/conditions.
If I do require medical treatment or attention for any reason directly or indirectly related to my participation in the Services, I agree that the medical costs are solely my responsibility, and I will defend, indemnify, and hold Riffs Yoga Studios, and its shareholders, directors, officers, employees, representatives, agents, and affiliates harmless from any charges, fees, or costs that providers of my medical treatment/attention may assess.
I agree that Riffs Yoga Studios is not responsible for the loss of, or damage to, any personal property that I bring to, or leave at, any Riffs Yoga Studios facility/studio or any event location.
ASSUMPTION OF RISK: I acknowledge that I am voluntarily and knowingly participating in the services provided by Riffs Yoga Studios. I understand that yoga, deep breathing exercises, alternating immersion in extremely cold and hot water, and the use of a sauna, by their very nature, involve inherent risks, including, but not limited to, those described in this waiver, and even the possibility of serious physical injury or death. I hereby assume all risks and responsibility for any injury, death, or medical condition that I might sustain.
RELEASE: I hereby release Riffs Yoga Studios, and its shareholders, directors, officers, employees, representatives, agents, and affiliates from liability for any injuries or death, and damages (whether tangible or intangible), that I may sustain before, during, or after participating in any of the services.
INDEMNIFICATION: I hereby agree to defend, indemnify, and hold Riffs Yoga Studios and each of its shareholders, directors, officers, employees, representatives, agents, and affiliates harmless against any legal claims, demands, and damages, of any nature, including reasonable attorney's fees, which may arise, directly or indirectly, from my use or misuse of the Services and my acts and omissions, including any intentional or inadvertent omission of necessary and relevant information. I agree that Riffs Yoga Studios can select its own legal counsel at my expense and may participate in its own defense, in its sole discretion.
CONTINUING WAIVER: This waiver is a continuing waiver of my rights and remains in full force and effect whenever I use or participate in any of the Riffs Yoga Studios Services, whether in person (indoors or outdoors), online, or via video conferencing, and whether at a Riffs Yoga Studios facility/studio or a remote event location.
BINDING EFFECT: This waiver binds and is enforceable against me and each of my heirs and personal representatives. I agree that this waiver is enforceable to the fullest extent provided by applicable law. I specifically acknowledge and agree that this waiver is not intended to be a general release but shall be construed and interpreted as broadly as allowed by California law. I irrevocably submit to the exclusive jurisdiction and venue of the federal and state courts located in San Diego County, California, for any legal suit, action, or proceeding arising out of, or based upon, this waiver.
REPRESENTATION: I am of legal age (18 years of age or older) and legally competent to enter into this waiver, and I am physically, mentally, and medically able to safely participate in the Services. If signing on behalf of a minor, I am the legal custodial parent or legal guardian of the minor identified in this waiver.
With my handwritten signature below, or my online electronic signature, or by clicking "I agree" at the Riffs Yoga Studios website, I confirm that I have read and understand this waiver; I understand and assume the risk of participating in any of the Services; I waive all rights and claims against, and I release and discharge, Riffs Yoga Studios, its shareholders, directors, officers, employees, representatives, agents, and affiliates regarding any injuries, tangible or intangible damages, loss of property, or loss of life that I may sustain before, during, or after my use of the Riffs Yoga Studios facilities/studio and participation in any of the Services.
